Unfair trade practices
The law establishes rules and a system of measures to prevent the imposition of unfair trade practices and establishes unfair trade practices in the food supply chain, the imposition of which exploits the significant bargaining power of purchasers and/or processors or traders in relation to their suppliers.
Since December 2017 the Croatian Competition Agency (CCA) has been collecting the questions relating to the issues linked to the application of the Act on the prohibition of unfair trading practices in the business-to-business food supply chain (UTPs Act) in Croatia.The UTPs Act entered into force on 7 December 2017 after it was published in the Official Gazette 117/2017.
The CCA Guidebook of Q&As replying to queries of the addressed actors and explaining the UTPs rules (Consolidated text of 5 October 2018, including the previous versions of 5 February 2018, 28 February 2018, 7 March 2018, 30 March 2018 and 5 October 2018) is the result of the collaboration with the Croatian Chamber of the Economy, the Croatian Employers Association, the Ministry of Agriculture, lawyers’ offices and addressed actors.
