CCA opens infringement proceeding against HD-WIN ARENA SPORT

On 26 July 2023 the Croatian Competition Agency (CCA) opened ex-officio proceeding against the undertaking HD-WIN ARENA SPORT d.o.o. from Zagreb to investigate whether this undertaking engaged in distribution of premium sports content channels abused its dominant position within the meaning of Article 13 of the Croatian Competition Act.

The CCA initiated the proceeding after having carried out the preliminary market investigation in the distribution of premium sports content in the Republic of Croatia that had been initiated following a complaint filed by the undertaking Telemach Hrvatska d.o.o. from Zagreb.

Namely, the legal and economic analyses in the preliminary defined relevant market indicated that there has been circumstantial evidence that HD-WIN ARENA holds a dominant position in the market concerned and that it has been applying dissimilar conditions to equivalent transactions with other trading parties in the distribution of premium sports content.

Concretely, the CCA found that there have been indices that HD-WIN ARENA has been placing Telemach at a competitive disadvantage in the pay TV market compared to other trading parties.

The CCA notes here that the mere opening of an infringement proceeding does not prejudice the infringement of competition rules. The CCA decides on the merit of the case according to the established facts of any case.
