The Council is the body that decides on all issues for which AZTN is competent in the implementation of ZZTN and ZNTP.
Competition Council
The CCA is run and managed by the Competition Council consisting of 5 members (president of the Council, vice-president of the Council and three members of the Council) who are appointed for a five-year term by the Croatian Parliament upon the proposal of the Government of the Republic of Croatia. The criteria for the appointment and the term of office of the president and the members of the Council are regulated by the Competition Act whereas the vice-president of the Council is elected by the members of the Council themselves, upon the proposal of the president of the Council.
The Competition Council decides on all issues under the scope of the Competition Act and the Act on the prohibition of unfair trading practices in the business-to-business food supply chain (UTPs Act).
The Competition Council adopts its decisions about all general and individual legal acts of the CCA at the sessions of the Competition Council, with the majority of at least three votes. When substantive decisions are adopted the president of the Council or the vice-president of the Council and at least two members of the Council must attend the session.
Unfortunately, in the first year of his third term of office, the president of the Council, Mladen Cerovac, passed away and the powers of the president of the Council were transferred to the vice-president of the Council, Vesna Patrlj, until the appointment of the new president. Namely, the Act on the Amendments to the Competition Act, OG 41/21 that entered into force on 24 April 2021 provides that the Government of the Republic of Croatia makes a public call for the proposals of the candidates for the president of the Council and its members to ensure transparency. The selected candidate from the public call is then proposed by the Government of the Republic of Croatia to the Croatian Parliament that appoints them.
On 1 October 2021 the Croatian Parliament adopted the decision on the appointment of Mirta Kapural PhD president of the Competition Council with a five-year mandate. Preceding this decision, the Croatian Parliament relived Mirta Kapural from the duty of the member of the Competition Council.
The CCA is currently run by the Competition Council consisting of Mirta Kapural, PhD, president of the Council, Vesna Patrlj, LLM, vice-president of the Council (third term of office March 2019 – March 2024), Ljiljana Pavlic, MSc, MBA, member of the Council (second term of office January 2019 – January 2024), and Denis Matić, LLM, member of the Council (second term of office January 2019 – January 2024).
